Terms & Conditions
Effective date: 1 July 2026 · Last updated: 1 July 2026
These Terms & Conditions govern your use of Calmsie Community, operated by Calmsie Sp. z o.o. By creating an account or otherwise using the Platform, you agree to them. They should be read together with our Privacy Policy.
The Platform has several distinct parts — forum, resources, breakout rooms, ask expert and marketplace — and our role is different in each. Section 2 summarises this at a glance, and the rest of the document explains it in detail.
1. Who we are
Calmsie Community (the "Platform") is operated by:
Calmsie Sp. z o.o.
ul. Piastów Śląskich 29/25, 01-494 Warsaw, Poland
VAT ID (NIP): PL7123401355
E-mail: contact@calmsie.ai
In these Terms, "Calmsie", "we", "us" and "our" mean Calmsie Sp. z o.o. "You" means the person using the Platform. These Terms form the regulations (regulamin) of the electronic services we provide within the meaning of Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means.
We have written them in plain language so they are easy to read. The legal substance is binding regardless of the informal tone.
2. What Calmsie Community is
The Platform is a parent-focused community and resource hub. It has four parts, and each part has different rules — most importantly around who is responsible for the content:
| Part of the Platform | Who creates the content | Calmsie's role |
|---|---|---|
| Forum | Parents and Educational Contributors | Hosting provider, light-touch moderation, not pre-moderated |
| Resources | Calmsie editorial team | Author / publisher — we take editorial responsibility |
| Breakout Rooms (Strefa Spotkań) | Calmsie experts and hosts | Organiser of live sessions hosted via Daily.co infrastructure |
| Ask Expert | Qualified Calmsie experts | Facilitator of private written Q&A — educational only |
| Marketplace — Calmsie products (NeuralPositive, Mission Amygdala, Lila and the Dragon) | Calmsie | Seller — full product responsibility |
| Marketplace — third-party products (with the Seal of Excellence) | Third-party makers and sellers | Curator and recommender only — not seller, not certifier |
Access to the Platform requires an active paid subscription (Starter, Plus, or Premium). A 7-day free trial is available for new users. Calmsie products in the Marketplace are sold separately at prices shown on the relevant product page.
3. Who can use the Platform
You must be 18 years old or older and have full legal capacity to register and use the Platform. The Platform is designed for parents and adult caregivers and is not intended for use by minors.
Most of the Platform is accessible after you create an account with an e-mail and password, or by signing in with Google. Educational Contributor status is granted only to users we invite, based on their professional background. Calmsie may withdraw contributor status at any time.
4. Your account
You are responsible for your account. That means:
- provide accurate information when you register, and keep it up to date;
- choose a strong password and do not share it;
- do not let anyone else use your account;
- tell us at contact@calmsie.ai as soon as you suspect unauthorised access.
The contract between you and Calmsie for use of the Platform starts when you finish registration and ends when you delete your account or we terminate it under Section 14. You can delete your account at any time from your profile, without giving reasons and at no cost.
5. Subscriptions, billing and cancellation
Subscription plans. The Platform is available on three subscription plans — Starter (14 PLN/month), Plus (59 PLN/month) and Premium (139 PLN/month) — or on annual plans (140 / 590 / 1390 PLN/year). All prices are gross prices inclusive of VAT and apply to individual customers. Business pricing is available on request at contact@calmsie.ai.
Free trial. New subscribers receive a 7-day free trial. A valid payment card is required to start the trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and your card will be charged.
Billing. Subscriptions renew automatically at the end of each billing period (monthly or annual). You will receive an invoice for each charge.
VAT and taxes. All prices displayed on the Platform are gross prices (inclusive of VAT). For users located in Poland, VAT is charged at 23%. For users located in other EU member states, the applicable local VAT rate may apply in accordance with EU VAT regulations. Users located outside the European Union may not be charged VAT. The applicable tax amount is calculated automatically at checkout based on your billing address and is displayed before payment is confirmed.
Add-on purchases. Certain features require additional one-time payments regardless of subscription tier — specifically individual Ask Expert questions and individual Breakout Rooms session registrations. Prices vary by subscription tier and are shown at the point of purchase.
Cancellation. You may cancel your subscription at any time from your profile settings. Cancellation takes effect at the end of the current billing period — you retain full access until that date. No refunds are issued for partial billing periods.
Right of withdrawal. As a consumer, you have a statutory 14-day right of withdrawal from a distance contract under the Polish Act on Consumer Rights. For subscription services that have already commenced with your express consent, this right may not apply or may be limited. For digital content delivered immediately, you expressly consent to delivery before the withdrawal period expires and acknowledge that the right of withdrawal is thereby lost. Full details are provided at checkout.
Referral codes. Each user receives a unique personal referral code. When a new user registers using your code, both you and the new user receive one free month added to your subscription (extended trial or subscription period). Referral codes may be used a maximum of 5 times per user.
6. Forum: peer support, not professional advice
The forum is a space for parents to talk with other parents. It works like conversations between friends or in a parent group — people share what they have experienced and what has worked for them. It is not a clinic, a helpline or a therapy service.
When Educational Contributors (including those with clinical backgrounds) take part in the forum, their role is educational only. They may share general information, point to evidence, or explain how a topic is usually understood. They do not:
- assess, diagnose or treat any individual user or any child;
- recommend a specific medication, therapy or care plan for your situation;
- enter into a clinician–patient or therapist–client relationship with you through the forum;
- handle emergencies or crisis situations.
Please do not ask any user — contributor or otherwise — for an individual diagnosis, prescription, dosage, treatment plan or crisis intervention. Anything that looks like personalised medical advice in a forum post is not a substitute for seeing a qualified professional, and you must not rely on it.
See the standalone medical disclaimer in Section 9 and the rules for Educational Contributors in Section 7.
7. Community rules
To keep the community safe and useful, please do not post or share:
- content that is illegal under Polish or EU law, including hate speech, incitement to violence, terrorism-related content, sexual content involving minors, or content that infringes intellectual property rights;
- threats, harassment, bullying, doxxing or other abuse aimed at any person;
- identifying information about other people (including children) without a clear legal basis and, where required, their consent;
- medical, psychological or psychiatric diagnoses, prescriptions, dosages or individual treatment recommendations directed at a specific user or child;
- claims of professional qualifications you do not have, or any other impersonation;
- spam, repetitive promotional content, chain messages, or commercial offers without our prior written approval;
- content that promotes self-harm, suicide, eating disorders or other behaviours that may harm vulnerable readers;
- scraping, automated access, reverse-engineering or anything that interferes with the operation or security of the Platform.
We may remove content that breaks these rules and apply consequences ranging from a warning to suspension or permanent termination of your account, depending on severity. Every removal or restriction follows the safeguards required by the Digital Services Act (Regulation (EU) 2022/2065), including a statement of reasons and an internal complaint route — see Section 14.
8. Educational Contributors
Educational Contributors are users we invite to share educational knowledge with the community, typically based on their professional background. Acting as an Educational Contributor is a privilege, not an employment relationship, and is subject to the rules in this Section in addition to the rest of these Terms.
As an Educational Contributor, you confirm and agree that:
- any professional credentials you list on your profile are true, current and verifiable;
- you act in an educational capacity only, and never give individual medical, psychological or psychiatric advice through the Platform;
- you do not establish a clinician–patient or therapist–client relationship with any user through the Platform, and your participation is not covered by professional indemnity for clinical practice;
- information you share is, to the best of your knowledge, accurate and based on current professional understanding, and you correct material errors when you become aware of them;
- you disclose any material conflict of interest (for example, a commercial relationship with a product or organisation you mention);
- you respect users' privacy and do not collect or process their personal data outside the Platform on the basis of your contributor role.
Calmsie may pause or revoke contributor status at any time, with or without notice, if these rules are not followed or in any other reasonable circumstance.
9. User-generated content and our hosting role
The forum and other interactive areas of the Platform are spaces for user-generated content. Calmsie does not pre-moderate posts and comments before they are published. You are solely responsible for the content you submit.
With respect to user-generated content, Calmsie acts as a hosting service provider within the meaning of Article 14 of Directive 2000/31/EC, Article 14 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means, and the rules for hosting services in Articles 4–6 of Regulation (EU) 2022/2065 (the Digital Services Act). We are not liable for unlawful user content of which we have no actual knowledge.
Notice and action. If you believe that content on the Platform is illegal or infringes your rights, send a notice to contact@calmsie.ai with: (i) a link to the content, (ii) an explanation of why it is illegal or infringing, (iii) your contact details, and (iv) a good-faith statement. We will review the notice promptly and, where appropriate, remove or disable access to the content and inform you and the person who posted it of the decision and the reasons for it.
Your licence to us. You keep ownership of the content you create. By posting it on the Platform, you grant Calmsie a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, distribute and adapt that content solely for the purposes of operating, providing, improving and promoting the Platform. This licence lasts for as long as the content is on the Platform and for a reasonable period after deletion for backups, legal compliance and archives. We will not sell your posts as standalone content, and we will not use your posts in advertising without your separate consent.
You confirm that you have all rights necessary to grant this licence and that your content does not infringe any third party's rights.
10. Medical disclaimer
Nothing on the Calmsie Community platform is medical advice. That includes forum posts, comments, Educational Contributor contributions, Resources articles, newsletters, marketplace descriptions and any other content, whether produced by us or by users.
The Platform is not a substitute for a consultation with a doctor, psychologist, psychiatrist, therapist or other qualified professional. Do not delay seeking professional advice because of something you read on the Platform. Always consult a qualified professional for diagnosis or treatment of any health condition affecting you or your child.
In an emergency, including a mental-health crisis or risk of self-harm, call the emergency number 112 in the European Union or your local emergency service immediately. In Poland you can also call the 24/7 crisis helpline for children and young people on 116 111 and the helpline for adults in emotional crisis on 116 123. Calmsie cannot monitor the Platform for emergencies and cannot provide crisis intervention.
11. Resources: our own editorial content
The Resources section contains articles, guides and tools written or formally approved by the Calmsie editorial team. This is our own content and we take editorial responsibility for it.
Our editorial standards:
- resources are written or reviewed by people with relevant subject-matter knowledge;
- where a resource refers to clinical or scientific topics, we aim to reflect the current evidence base in plain language;
- we date and version material so you can see when it was last reviewed;
- we correct material errors promptly when we become aware of them.
Our editorial standards do not turn Resources into clinical guidance. Resources are provided for general information and education; they describe how topics are commonly understood, not how a specific situation should be treated. The medical disclaimer applies fully. Where a resource covers a sensitive topic, we may recommend consulting a qualified professional before acting on the information.
12. Ask Expert
The Ask Expert feature allows users to submit a private written question to a qualified Calmsie expert and receive a personalised response within 48 hours.
- Ask Expert is included in Plus (3 questions/month) and Premium (10 questions/month) plans. Starter users may purchase individual questions as add-ons.
- Questions submitted through Ask a Calmsie Expert are limited to 1,000 characters (including spaces). Questions exceeding this limit cannot be submitted.
- Our experts will make every reasonable effort to respond to your question fully and in a timely manner. Response times may vary depending on demand.
- Each submitted question entitles you to one follow-up message within the same conversation thread. The follow-up is also subject to the 1,000-character limit. Additional follow-ups beyond the first are not included unless you submit a new question, which counts against your monthly allowance.
- Ask Expert responses are provided for general informational and educational purposes only. They do not constitute medical, psychological, psychiatric, legal or financial advice, diagnosis, or treatment. Responses must not be relied upon as a substitute for advice from a qualified professional, and Calmsie expressly excludes liability for any decision made or action taken in reliance on an expert response. The medical disclaimer applies fully to all Ask Expert responses.
- Experts are qualified professionals acting in an educational capacity. No clinician–patient or therapist–client relationship is established through Ask Expert.
- Questions and responses are private between the user and the assigned expert. They are not visible on the forum.
- Calmsie reserves the right to decline to answer questions that are off-topic, inappropriate, or outside the scope of the Platform's focus on child development and parental wellbeing.
13. Breakout Rooms (Strefa Spotkań)
Breakout Rooms (Strefa Spotkań) is a section of the Platform hosting live sessions, webinars and group meetings with experts.
- Sessions are included free for Premium subscribers. Starter and Plus subscribers may purchase individual session registrations as add-ons.
- Sessions may require camera and microphone access. You grant permission when joining a session. You may join as a listener only (audio and video off) if you prefer.
- Sessions are hosted using Daily.co video infrastructure. By joining a session you agree to Daily.co's terms of service applicable to end users.
- Sessions are not recorded. No video or audio recordings are made of live sessions, to protect the privacy of all participants.
- The session host and Calmsie administrators may mute participants, disable cameras, or remove participants who violate community rules during a session.
- Registered users who do not attend a session are not entitled to a refund of their add-on purchase.
14. Marketplace: our products and recommended products
The Marketplace has two tiers. Each is labelled in the interface and treated differently in these Terms:
Tier 1 — Calmsie products (we are the seller)
Products created and sold by Calmsie — currently NeuralPositive, Mission Amygdala and Lila and the Dragon, and any other items we add and mark as "by Calmsie". For these products:
- Calmsie is the seller. The sales contract is concluded between you and Calmsie Sp. z o.o.
- Calmsie takes product responsibility as the seller, including statutory liability for non-conformity under Polish and EU consumer law (the Polish Act of 30 May 2014 on Consumer Rights and Directive (EU) 2019/771).
- Consumer right of withdrawal. If you buy as a consumer, you normally have 14 days to withdraw from a distance contract under the Polish Act on Consumer Rights. Statutory exceptions apply — in particular, digital content supplied immediately with your express consent and sealed goods unsuitable for return for health/hygiene reasons after unsealing. The applicable rules and the withdrawal form will be presented on the product page before purchase.
- Complaints about Calmsie products can be sent to contact@calmsie.ai. We will respond within 14 days as required by Polish consumer law.
Tier 2 — Recommended third-party products (Seal of Excellence)
Products made and sold by third parties that Calmsie's editorial team considers potentially useful for parents. Items chosen by our editorial team carry the "Seal of Excellence by Calmsie" badge. The Seal of Excellence is:
- an editorial opinion of the Calmsie team that a product is worth considering;
- not a certification, not a warranty, not a safety mark, not a clinical endorsement and not a guarantee of efficacy or fitness for any particular purpose;
- not a substitute for your own judgement or for professional advice where relevant.
For recommended third-party products:
- Calmsie is not the seller. Any purchase is made directly with the third-party seller, under that seller's terms.
- Calmsie does not guarantee the availability, quality, safety, legality or suitability of any recommended product and is not liable for the product itself, the seller's content or any outcomes from its use. Disputes about a purchase must be resolved with the seller.
- Some listings include affiliate links or other commercial arrangements. Calmsie may receive a commission if you purchase through such a link, at no additional cost to you. Where such an arrangement exists, it is disclosed on the listing. Commercial relationships do not influence whether a product receives the Seal of Excellence.
16. Intellectual property
The Platform, its software, design, the names Calmsie, NeuralPositive, Mission Amygdala, Lila and the Dragon, the Seal of Excellence badge and the Resources written by Calmsie are protected by copyright, trade-mark and other intellectual property laws and belong to Calmsie or its licensors. You may use them only as needed to use the Platform as a user.
You keep the rights to the content you create. See Section 8 for the licence you grant us when you post.
17. Suspension, termination and complaints about moderation
You may delete your account at any time from your profile or by writing to contact@calmsie.ai.
Calmsie may restrict, suspend or terminate your access — and remove or restrict specific content — if you seriously or repeatedly break these Terms or applicable law, or if there is a clear safety, security or legal reason to do so. We will give you a statement of reasons as required by the Digital Services Act, except where doing so would prejudice an ongoing investigation or be otherwise unlawful.
You may complain about any moderation decision by writing to contact@calmsie.ai within 6 months of the decision. We will review your complaint by a human reviewer who did not take the original decision, and respond within a reasonable time and in any event within 14 days where Polish consumer law applies. You also have access to out-of-court dispute settlement under Article 21 of the Digital Services Act and, as a consumer, to the EU ODR platform (ec.europa.eu/consumers/odr).
18. Liability
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:
- Calmsie is not liable for content posted by users, for advice users give one another, for decisions you make based on user content or Resources, or for outcomes of using third-party products listed in the Marketplace.
- Calmsie is not liable for indirect, incidental or consequential damages, loss of profit, loss of data or loss of goodwill arising out of the use of, or inability to use, the Platform.
Nothing in these Terms limits Calmsie's liability where the law does not permit such limitation — in particular for intentional misconduct, for the seller's statutory liability for Calmsie's own products, for damage to life or health, or for any other liability that cannot be excluded under mandatory Polish or EU law (including the Polish Civil Code).
19. Personal data
Calmsie processes personal data of users in accordance with the Privacy Policy, which forms an integral informational part of these Terms and explains your GDPR rights.
20. Changes to these Terms
We may amend these Terms for valid reasons — for example a change in the features of the Platform, a change in applicable law, or a need to address security or abuse. We will notify registered users of material changes by e-mail or in-app notice at least 14 days before they take effect. If you do not accept the new Terms, you can delete your account before they come into force.
21. Governing law and jurisdiction
These Terms are governed by the law of the Republic of Poland. Disputes arising out of or in connection with the Platform are subject to the courts having jurisdiction under Polish procedural law. If you are a consumer habitually resident in another EU Member State, you keep the protection of the mandatory consumer-protection provisions of the law of your country of residence.
22. Contact
Questions about these Terms? Write to contact@calmsie.ai, or to Calmsie Sp. z o.o., ul. Piastów Śląskich 29/25, 01-494 Warsaw, Poland.
